US “Duration of Status” rule postponed by federal court
A federal court in Massachusetts issued preliminary relief on 14 September 2026, postponing implementation of the DHS final rule that would replace the current Duration of Status framework. The rule therefore did not take effect on 15 September 2026; litigation continues.
Current position: The existing Duration of Status framework remains in effect for now. Re-check the court/DHS position before advising students on future implementation.
🌐 Destination Spotlight — What Changed in the Last Two Weeks
🇺🇸 USA Top destination for Indians. Visa rules in active litigation right now. Visa ✓ Good news (for now)
DHS announced its final rule ending "Duration of Status" for F-1/J-1/M-1 holders on 16 July 2026 (published in the Federal Register the next day), replacing it with a fixed admission period capped at 4 years and requiring a formal USCIS extension application for longer stays. It was due to take effect 15 September 2026. U.S. District Judge F. Dennis Saylor IV (District of Massachusetts, Boston) blocked it on 14 September, one day before implementation — but the litigation is ongoing and DHS may appeal.
Verified status: The rule was postponed by preliminary court relief on 14 September 2026; the existing D/S framework remains in effect for now.
🇬🇧 UK Graduate visa duration changes from 1 January 2027. Visa ⚠ Heads up
The Graduate Route reduction to 18 months for Bachelor's/Master's graduates is confirmed for applications submitted on or after 1 January 2027; PhD stays at 3 years. Separately, maintenance-fund amounts rise from 30 November 2026 to £1,570/month in London and £1,203/month outside London — the required 28-day funds-holding period itself is not changing. Apply for the Graduate Route by 31 December 2026 to lock in the full 2 years.
Verified status: GOV.UK confirms 2 years for Graduate visa applications made on or before 31 December 2026, 18 months for applications from 1 January 2027, and 3 years for PhD/doctoral qualifications.
🇨🇦 Canada Living-expense amount updated from 1 September 2026. Policy ⚠ Heads up
From 1 September 2026, students applying for a study permit outside Quebec must show C$23,448 in living-cost funds for a single applicant — excluding tuition and transportation, which must be shown separately. This is up from C$22,895 (the figure in force from 1 Jan 2025 to 31 Aug 2026). IRCC is also strengthening compliance checks for study permit extensions from applicants whose original permits were processed under the former Student Direct Stream, including investigation of higher-risk cases, and is tightening scrutiny of suspected fraud/misrepresentation on letters of acceptance. On the upside, the 2026 PGWP-eligible field-of-study list stays frozen — no additions or removals during the year (degree — bachelor's/master's/doctoral — graduates are generally exempt from the field-of-study requirement; it mainly affects certain non-degree programmes, so check the specific CIP code).
Verified status: For applications made on or after 1 September 2026, the living-expense amount for one person outside Quebec is C$23,448, excluding tuition and transportation.
🇩🇪 Germany APS eligibility criteria for Indian UG applicants updated for Winter 2026/27. Intake 👀 Watch
From Winter Semester 2026/27, APS India requires a minimum of 70% in Class 12 for undergraduate applicants (Studienkolleg and direct-entry routes only) — Master's and PhD applicants are assessed on their Bachelor's record and are not affected. Students below 70% need to check alternate UG routes early. APS is now fully digital via aps-india.de (INR 18,000, 3–4 week processing), and Germany permanently abolished the informal "remonstration" appeal for refused visas from July 2025, so a rejected application now means reapplying from scratch or going to court — there's no quick fix.
Verified status: APS India says that from Winter Semester 2026/27, the updated eligibility criteria include a minimum 70% of maximum achievable marks in Class XII for the stated undergraduate routes. Germany's Federal Foreign Office abolished the visa remonstration procedure worldwide from 1 July 2025.
🛂 Verified Visa Watch
USA: DHS's Duration of Status rule was postponed by federal court action on 14 September 2026; the current framework remains in effect for now.
UK: Graduate visa duration is 2 years for applications by 31 December 2026 and 18 months from 1 January 2027; doctoral qualifications remain at 3 years.
Canada: Living-expense proof for one applicant outside Quebec is C$23,448 for applications from 1 September 2026.
Germany: APS's updated Class XII eligibility criteria apply to Winter Semester 2026/27; remonstration for visa refusals was abolished worldwide from 1 July 2025.
